ICQ Chat Network is a global chat community built on Internet Relay Chat (IRC) technology. We believe in protecting the privacy of our users while ensuring our platform is not used for illegal activities. We comply with legally valid and enforceable requests from law enforcement agencies worldwide, provided they follow the proper legal channels.

We will only release user data when compelled by a valid subpoena, search warrant, or court order issued by a court with proper jurisdiction. We require all requests to be specific, narrowly tailored, and supported by applicable law.

What Data We Retain

Understanding what data we store is essential for submitting a proper request. Please review the following:

  • Chat Logs: As a standard IRC network, we do not actively log or permanently store private or public chat messages. Logs are generally ephemeral and are not retained beyond operational necessity.
  • Registration Data: When users register a nickname or channel via NickServ/ChanServ, we store the registered username, associated email address, and registration timestamps.
  • IP Addresses: We may temporarily store IP addresses for security purposes (e.g., preventing abuse, managing bans). These are not permanently retained unless required for ongoing investigations.
  • Connection Logs: Basic connection logs (date, time, IP) are kept for a limited period for network maintenance and security monitoring.

Submitting a Law Enforcement Request

To ensure timely processing, all law enforcement requests must include the following information:

Required Details

  • Agency Information: Full name of the law enforcement agency, department, and jurisdiction.
  • Requesting Officer: Full legal name, badge/ID number, official email address, and phone number of the officer submitting the request.
  • Legal Instrument: A copy of the valid subpoena, court order, or search warrant. The document must include the court's name, signature, case number, and date.
  • Specific Data Requested: Clearly describe the exact data being requested (e.g., registered email, IP logs, account information) and why it is relevant.
  • User Identification: Provide the specific nickname, registered email, or IP address associated with the account in question.

Where to Send Requests

All official law enforcement requests must be submitted through our Support Desk to ensure proper tracking and verification. Please do not send sensitive legal documents via unencrypted channels unless necessary.

Emergency Requests (Imminent Harm)

In situations involving imminent threat to life or serious physical injury, we may expedite requests. For emergency situations, please ensure:

  • The request is clearly marked "EMERGENCY - IMMINENT HARM" in the subject line.
  • Include a detailed explanation of the nature of the emergency and why immediate action is required.
  • A formal legal request must still be submitted via the Support Desk as soon as possible after the emergency.

⚠️ Note: Expedited processing does not guarantee the availability of data, as we do not retain permanent logs of all conversations.

User Notification Policy

ICQ Chat Network believes in transparency. Whenever legally permitted, we will notify the affected user that their data has been requested by law enforcement before or shortly after compliance.

However, we are legally bound to withhold notification if:

  • We are prohibited from doing so by a court-ordered gag order or non-disclosure agreement.
  • Disclosure would impede an ongoing investigation.
  • Disclosure would pose a threat to national security or public safety.

Preservation Requests

If a law enforcement agency is in the process of obtaining a legal request but needs us to temporarily preserve specific data, we may accept a preservation request. Preservation requests must:

  • Be submitted by a recognized law enforcement agency.
  • Specify the exact data to be preserved and the duration of preservation.
  • Be followed by a formal legal request within the preservation period (typically 90 days, subject to extension).

Limitations & Disclaimer

Please be aware of the following limitations:

  • No Guarantee of Data: Due to our privacy-first architecture and limited data retention policies, we may not have the requested data available.
  • Jurisdiction: We are not obligated to respond to requests from foreign jurisdictions that do not comply with international legal standards unless supported by a Mutual Legal Assistance Treaty (MLAT) or equivalent.
  • Fees: We reserve the right to charge reasonable fees to cover the administrative costs of processing complex requests.
